Avoiding Wage and Hour Liability - How to Pay Employees Lawfully

The panel will discuss how small businesses can identify and avoid common misconceptions and pitfalls in wage and hour policies and practices. Topics will include:
1. Do I have to pay my employee overtime? Can’t I just pay a salary and avoid the whole problem? Which employees can I treat as “exempt” from overtime law, and which employees must I pay overtime (“non-exempt”)?
2. Do I have to record how much time my employee works each week? What time counts – getting ready for work, working after hours, taking work home, checking e-mail, travel time?
3. How must I calculate overtime pay properly? What if I pay a “salary”? Or bonuses? Or if I don’t pay by the hour (commissions, piece rate)?
4. If my employee qualifies as "exempt," what are the rules for calculating and paying salary properly? If I break those rules, do I have to pay that employee overtime?
5. What about bonuses? What are the wage & hour rules about the effect of bonuses for “non-exempt” and “exempt” employees?
6. Can’t I just call them all “independent contractors” and avoid the whole problem?
